Terms of Service

These Terms of Service ("Terms") govern your access to and use of the products and services provided by 26 Degrees Software LLC ("we," "us," or "our"), including the 26 Cloud Platform, ViewAQC, Collectus, 26 AI Assist, 26 Insights, and related websites and APIs (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. Acceptance of terms

By creating an account, accessing, or using the Services, you represent that you are at least 18 years of age and have the authority to bind the entity on whose behalf you are using the Services. If you do not agree to these Terms, do not use the Services.

2. Description of services

26 Degrees Software provides cloud-native BIM software for the architecture, engineering, construction, and operations (AEC&O) industry. The Services include desktop add-ins, web applications, APIs, and related tools for BIM coordination, data aggregation, quality control, and AI-assisted workflows. Service availability and features may vary by subscription plan.

3. Accounts and access

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must provide accurate and complete registration information.
• You must promptly notify us of any unauthorized use of your account.

4. Subscriptions and payment

• Paid features require an active subscription. Pricing and plan details are available on our Pricing page.
• Subscriptions are billed in advance on a monthly or annual basis, as selected at the time of purchase.
• All fees are non-refundable except as expressly stated in these Terms or required by law.
• We reserve the right to change pricing with 30 days' written notice. Price changes do not affect the current billing cycle.

5. Your data

• You retain all ownership rights in the data you upload to the Services ("Your Data").
• You grant us a limited license to host, store, process, and display Your Data solely to provide the Services.
• We do not use Your Data to train machine-learning models outside your tenant.
• We do not sell Your Data. See our Privacy Policy for details on how we handle personal information.
• You are responsible for maintaining backups of Your Data outside the Services.

6. Acceptable use

Your use of the Services is subject to our Acceptable Use Policy. You agree not to use the Services for any unlawful purpose or in violation of these Terms.

7. Intellectual property

• The Services, including all software, designs, documentation, and trademarks, are the property of 26 Degrees Software LLC and are protected by applicable intellectual property laws.
• These Terms do not grant you any right to use our trademarks, logos, or brand features without prior written consent.
• Feedback or suggestions you provide about the Services may be used by us without obligation to you.

8. Third-party services

The Services may integrate with third-party products (e.g., Autodesk Revit, Navisworks). Your use of third-party products is governed by their respective terms. We are not responsible for the availability, accuracy, or practices of third-party services.

9. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. Enterprise customers may negotiate specific SLAs as part of their contract.

10. Limitation of liability

To the maximum extent permitted by applicable law:

• The Services are provided "as is" and "as available" without warranties of any kind, express or implied.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
• Our total aggregate liability for any claims related to the Services shall not exceed the amounts you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless 26 Degrees Software LLC, its officers, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

12. Termination

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy.
• Upon termination, we will make Your Data available for export for 30 days, after which it may be deleted.

13. Modifications to terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or in-app notification. Your continued use of the Services after the effective date of updated Terms constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Collier County, Florida.
